After a tumultuous legal feud, Johnny Depp and Amber Heard have come to terms on a settlement, and the appeals to their defamation suit are no longer moving forward. Heard announced on Monday with a statement posted to social media that she made the “very difficult decision” to settle. She says that she still stands by her allegations but that she just couldn’t handle going through another trial, which is what would happen if her pending appeal was successful.

“Time is precious, and I want to spend my time productively and purposefully,” Heard’s statement read in part. “For too many years I have been caged in an arduous and expensive legal process, which has shown itself unable to protect me and my right to free speech. I cannot afford to risk an impossible bill – one that is not just financial but also psychological, physical, and emotional. Women shouldn’t have to face abuse or bankruptcy for speaking her truth, but unfortunately, it is not uncommon.”

Meanwhile, per Variety, Depp’s attorneys Benjamin Chew and Camille Vasquez had something else to say about the settlement. In a joint statement, they reveal that the terms of the settlement include Heard paying Depp $1 million through her insurance company. That’s significantly less than the $10.35 million he was awarded, but as the attorneys state, the goal of the trial was to bring “the truth to light.” They also say that Depp will “actually” donate the full million to charities.

“We are pleased to formally close the door on this painful chapter for Mr. Depp, who made clear throughout this process that his priority was about bringing the truth to light,” the statement reads. “The jury’s unanimous decision and the resulting judgment in Mr. Depp’s favor against Ms. Heard remain fully in place. The payment of $1 million – which Mr. Depp is pledging and will (actually) donate to charities – reinforces Ms. Heard’s acknowledgment of the conclusion of the legal system’s rigorous pursuit for justice.”

Depp’s lawyers are alluding to claims made by Heard after her divorce with Depp that she’d be donating the full $7 million she was awarded to charities. During the trial, Depp’s attorneys introduced evidence that Heard hadn’t even donated half of what she’d pledged. They also played interview footage of Heard clearly stating that she “donated” the money. In her defense, Heard claimed she uses the words “pledged” and “donated” synonymously, but this moment likely had a heavy effect on her credibility in the eyes of the jury.

“This is another one of those examples if you pull back and you think about it, I shouldn’t have had to have donated it in an attempt to be believed,” Heard told Savannah Guthrie in a post-trial interview, arguing she shouldn’t have had to donate the money in the first place.

“You shouldn’t have but once you said you did,” Guthrie said.

“Right and that was where it was intended to go,” Heard shot back, alleging that the trial’s court costs had delayed her plans to donate the money.
